Optando LLC Acceptable Use Policy

This Acceptable Use Policy ("AUP") applies to your access to and use of EVAP.io and any related software, applications, websites, APIs, SDKs, or services provided by Optando, LLC (collectively, the "Service"). This AUP is incorporated by reference into the Terms of Service and forms part of the agreement between you and Optando.

1. Scope and Purpose

The Service is a real-time communications platform. This AUP is designed to help keep the Service safe, lawful, and reliable for all users, including consumer users, enterprise customers, and white-label deployments.

2. Definitions

"User Content" means any data, content, communications, media, or materials transmitted, processed, stored, or displayed through the Service (including audio, video, messages, files, images, and metadata).

"Customer" means an organization or individual using the Service directly or via a white-label or enterprise deployment. "End User" means an individual using the Service through a Customer.

3. General Compliance

You are independently responsible for complying with all applicable laws and regulations in connection with your use of the Service. You may not use the Service for any unlawful, harmful, abusive, or prohibited purpose.

4. Prohibited Activities

You may not use the Service to do any of the following (whether directly or indirectly, including by attempting to promote, coordinate, facilitate, or instruct others to engage in such activity):

  1. Illegal activity. Violate any law, statute, ordinance, regulation, court order, or legal obligation.
  2. Child safety. Create, upload, share, solicit, or promote child sexual abuse material ("CSAM") or any sexual content involving minors. Any suspected CSAM is strictly prohibited.
  3. Harassment and threats. Harass, stalk, intimidate, threaten, abuse, or encourage violence against any person or group, including hate-based conduct.
  4. Hate and extremist content. Promote hate, violence, racial or ethnic intolerance, or extremist activity, or praise or support violence.
  5. Non-consensual or exploitative content. Share intimate imagery without consent, engage in sexual exploitation, human trafficking, or any form of coercion.
  6. Obscene or unlawful sexual content. Share content that is obscene or otherwise illegal under applicable law.
  7. Privacy violations and doxxing. Collect, harvest, disclose, or distribute personal information of third parties without authorization, including doxxing, identity theft, or unauthorized recording where prohibited by law.
  8. Impersonation and deception. Impersonate another person or entity, misrepresent affiliation, or engage in fraud, scams, phishing, or social engineering.
  9. Malware and technical abuse. Upload, transmit, or distribute malware, viruses, worms, Trojan horses, or other harmful code; or attempt to exploit vulnerabilities.
  10. Unauthorized access. Attempt to gain unauthorized access to the Service, accounts, networks, or systems; probe or scan for vulnerabilities; or circumvent security or access controls.
  11. Service disruption. Interfere with or disrupt the integrity, performance, or availability of the Service, including denial-of-service attacks, automated abuse, or resource exhaustion.
  12. Automation and load testing. Use robots, spiders, scrapers, offline readers, load testers, or similar automated means to access the Service in a way that exceeds normal human usage patterns, except where Optando has provided prior written permission.
  13. Spam and unsolicited communications. Send unsolicited promotional messages or spam, or use the Service for commercial solicitation without authorization.
  14. Intellectual property infringement. Upload, transmit, store, or share content that infringes copyrights, trademarks, trade secrets, rights of publicity, privacy rights, or other proprietary rights.
  15. Weapons and dangerous goods. Use the Service to promote or facilitate unlawful procurement, manufacture, or use of weapons, ammunition, regulated firearms parts, or other regulated weapons under applicable law.
  16. Controlled substances. Use the Service to promote or facilitate unlawful manufacture, sale, or distribution of narcotics, controlled substances, or drug paraphernalia, or other products that present a risk to consumer safety.
  17. Fraud-prone goods/services. Use the Service to promote or facilitate products or services identified by government agencies as having a high likelihood of being fraudulent.
  18. Regulated sales. Promote or facilitate unlawful sale of tobacco products, e-cigarettes, or prescription drugs and devices.
  19. Gambling and gaming. Promote or facilitate unlawful gambling, gaming, or sweepstakes activity where prohibited by law, or without required approvals and permissions.
  20. High-risk or emergency reliance. Rely on or represent the Service as suitable for emergency, medical, life-safety, or other high-risk uses where failure or delay could result in harm.
5. Reporting and Complaints

To report suspected abuse, security issues, illegal activity, or intellectual property infringement, contact Optando support via the contact methods listed on the Service website.

6. Enforcement

Optando reserves the right to investigate suspected violations of this AUP and to take appropriate action, including restricting, suspending, or terminating access to the Service, removing or limiting content where feasible, and taking steps necessary to protect the Service, its users, and Optando's legal obligations.

7. Law Enforcement and Legal Compliance

Optando may cooperate with law enforcement authorities, regulators, or courts where required by applicable law, legal process, or valid governmental request.

Nothing in this AUP limits Optando's ability to disclose information or take action as required to comply with applicable laws, regulations, subpoenas, court orders, or other lawful requests.

8. Changes to this AUP

Optando may update this AUP from time to time. Changes become effective when posted. Continued use of the Service after updates constitutes acceptance of the revised AUP.

9. Relationship to Other Policies

This AUP supplements (and does not replace) the Terms of Service and Privacy Policy. If there is a conflict between this AUP and the Terms of Service, the Terms of Service control unless explicitly stated otherwise.
